License Conditions for InfoCAD Trial Licenses

§ 1 Scope of license, licensor
The license covers the modules of the program system InfoCAD for Windows® operating systems. Licensor and owner of all rights of use is InfoGraph GmbH, Aachen, Germany.

§ 2 Terms of use, time limit, cost
(1) The trial license is issued for testing in a freelance or commercial environment for the licensee registered in the online registration. Use for preparation of stability proofs or structural engineering tests is excluded.
(2) The term of the license is limited to 30 days from the date of registration. The provision of the trial license is free of charge for the licensee.

§ 3 License conditions
(1) The Licensor grants the Licensee a non-exclusive, non-transferable license to use the programs created by the Licensor on the Licensee's registered computer. For registration purposes, a unique identifier is generated from the hardware components of the computer and stored by the Licensor.
(2) In order to check the license, the programs will establish an Internet connection if necessary. The respective service provider may charge usage fees for establishing the Internet connection, over which the licensor has no influence.
(3) The programs and operating instructions are protected by copyright. Transfer of the programs to third parties and the removal or invalidation of the software protection are not permitted.
(4) If unauthorized persons are allowed to use the programs or the software protection is removed or disabled by the Customer or by a third party whom the Customer has given access to the programs, the Customer shall be required to pay a contract penalty in the amount of the licensing fee for each case of violation. The right to assert additional damages shall be reserved.
(5) Warranty claims and claims for damages by the licensee arising from the use of the program system are excluded. The Licensee shall indemnify the Licensor against any third-party claims to the extent permitted by law.

§ 4 Privacy
The licensee declares his consent in accordance with the European General Data Protection Regulation (GDPR), Article 6, paragraph 1, letter (a), that his personal data, his IP address, transmitted files and the resulting usage data are stored electronically for the provision of the license. The licensee has the right to information, correction, limitation, blocking and deletion of his data. The following institution is responsible as supervisory authority under Article 77 of the GDPR: Landesbeauftragte für Datenschutz und Informationsfreiheit Nordrhein-Westfalen, Kavalleriestr. 2-4, 40213 Düsseldorf, Germany.
